It is submitted by learned counsel for the applicant that according to the prosection version the applicant is not named in the F.I.R., but during investigation the evidence of extra judicial confession has been collected by the I.O. It is alleged that from the possession of the applicant looted food grains were recovered. Co-accused Raheemuddin, Saleem, Nasru, Gul Mohammad and Samsuddin have been released on bail by this court.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Faimuddin involved in Case Crime No. 37 of 2006, under Sections 1396 and 412 I.P.C., and Sections 2/3 U.P. Gangsters and Anti Social Activities (Prevention) Act, Police Station Agauta District Bulandshahar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
