Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that according to dying declaration the role of the applicant is identical with the role of co-accused Sasleem. Co-accused Sasleem and Mainuddin have been released on bail by this court on 22.11.2006 in Criminal Misc Bail Application No. 22149 of 2006. The applicant is also entitled to get the benefit of parity.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Rajna Begum involved in Case Crime No. 181 of 2006, under Section 302 I.P.C., Police Station Jigna , District Mirzapur be released on bail on his furnishing a personal bond and two heavy sureties each of the like amount to the satisfaction of the Court concerned.
