This Writ Petition has been filed raising a large number of grievances particularly that the petitioners' land is being encroached upon by the respondents and for that purpose a detailed representation has been sent to the District Magistrate, Allahabad. There is no order of acquisition of the property of the petitioners nor any procedure prescribed by law has been followed and the petitioners are being dispossessed from their land illegally. As the representation was made before the District Magistrate, Allahabad on 27th January, 2006 and the Writ Petition was filed on 28th January, 2006, the District Magistrate, Allahabad could not have considered and disposed of the said representation.

The learned Standing Counsel has assured the Court that the case of the petitioners shall be considered and examined strictly in accordance with law by the District Magistrate within a period of two weeks from the date of filing the certified copy of the order which the petitioners undertake to file within three days.

In view of the above, we dispose of the Writ Petition directing the District Magistrate, Allahabad to consider the grievance of the petitioners and pass an appropriate order on the representation dated 27th January, 2006  within a period of 10 days from the date of filing the certified copy of the order along with the copy of the Writ Petition. However, for a period of two weeks status quo shall be maintained regarding the possession of the land in dispute.
