Heard learned counsel for the petitioner and the learned A.G.A. for the State.
This petition is filed by the petitioner Dr. Tota Ram Maurya with a prayer that the F.I.R.of case crime no. 48 of 2006 under Sections 304 A I.P.C. Police station Fareedpur, District Bareilly may be quashed.
Perusal of the F.I.R. indicates that prima-facie cognizable offence is made out. No ground for making any interference is made out.
The petition is accordingly dismissed.
However, it is provided that in case the petitioner appears before the court below, within ten days from today, and applies for bail in the above case the same shall be heard and disposed of expeditiously in accordance with law by the courts below.
