Petitioner's petrol pump has been sealed by the respondent on the ground that the sample of diesel oil taken from the retail out let was not found up to the specification.
According to the petitioner the testing was done by mobile laboratory results of which are not reliable.
In the circumstances, the Respondent-Corporation is directed to either get the second sample which was handed over to the petitioner, or get fresh sample from the sealed tank and to have it tested by a regular laboratory within ten days of the date on which a certified copy of this order is presented before the respondent no.3. If upon such regular testing the sample is found in order, the respondent will remove the seal and allow the retail out let to function normally, otherwise the respondent will hand over a copy of regular analysis report to the petitioner after which he may avail such legal remedy to which he is entitled.
The writ petition is disposed of as above.
