Smt. Savitri Devi v. Smt. Gulabi Devi - WRIT - C No. 6389 of 2006 RD-AH 2549 (1 February 2006)
Hon'ble Umeshwar Pandey, J.
Heard learned counsel for the parties.
This writ petition under Article 226 of Constitution of India does not appear to be at all maintainable against the orders passed by the revisional court, whereby it has been directed that the petitioner plaintiff may on a fresh application, if she so desire, get the disputed spot inspected by the Commissioner, in case, the location of the property in dispute and its topography is required to be obtained by the plaintiff. She has been given liberty to move the trial court for the same. There was absolutely no occasion for the petitioner to have unnecessarily jumped to this court in writ jurisdiction.
The writ petition being misconceived is hereby dismissed.
