This is a writ petition for direction to the respondents no. 1 and 2 not to permit respondents no. 3 and 4 or any other person to hold market or cattle fair or Bazar on old plot no. 310 ( new plots no. 121, 122 and 123 ) situate in village Kataiya Baldeo Singh Tehsil Nawabganj distrtict Bareilly.
We have heard counsel for the petitioner, the Standing counsel and Sri V.K. Singh for the respondents.
According to the petitioner she has got a licence to hold cattle market as well as Bazar on the said land and respondents no. 3 and 4 have no such licence, yet Bazar is being held by them which is creating law and order problem, hence, the present writ petition.
In the circumstances of the case, it will be appropriate that the petitioner may file fresh representation before respondent no. 1. In case the representation is filed, the same may be decided by the said respondent by a reasoned order at an early date, if possible, within three months from the date of receipt of the representation. The petitioner will file a certified copy of this order; necessary documents and a duly stamped self addressed envelope along with the representation. The concerned authority after taking decision will communicate the same to the petitioner.
With these observations the writ petition is disposed of.
