Heard learned counsel for the petitioners and learned Standing Counsel.
From material on record it transpires that on an application filed by petitioners on the ground of getting possession through sale deed, the mutation court as well as appellate court passed orders in favour of transferees-petitioners. The revision against the said order was allowed by Board of Revenue. Against which, a review is pending before Board of Revenue.
Considering the facts and circumstances of the case and materials on record, this Court is of the view that Board of Revenue may be directed to decide review by the next date fixed i.e. 28.2.2006. In case of any difficulty to decide on the date fixed, the same shall be heard and decided within one month.
Accordingly, writ petition is allowed. A writ of mandamus is issued commanding Board of Revenue U.P. Meerut Branch to decide review application on the next date or within one month from the date of presentation of a certified copy of this order.
Let a certified copy of this order be issued to learned counsel for the petitioners on payment of usual charges within 24 hours.
