Heard learned counsel for the applicants and learned A.G.A. and Sri R.S. Yadav learned counsel for the complainant
It is contended by the learned counsel for the applicants that in the present case the learned A.C.J.M., Kashiya district Kushinagar had issued bailable warrants of Rs. 10000/- against the applicants in case no. 5787 of 2003. It is further contended that the applicants are peace loving and law abiding persons. They undertake that they shall co-operate with the proceedings of the trial and they shall not tamper with the evidence. It is further contended that the applicants want to appear before the court concerned to furnish personal bond of Rs. 10000/- but there is reasonable apprehension in their mind that the learned A.C.J.M. Kashiya shall not accept the same.
It is opposed by the learned A.G.A. and learned counsel for the complainant by submitting that in this case N.B.W. Has been issued today..
Considering the facts and circumstances of the case and submissions made by the learned counsel for the applicant it is directed that in in pursuance of the order dated 7.12.2005 passed by the learned A.C.J.M. Kashiya, Kushinagar if the appellants appear before the court concerned and furnish their personal bonds of Rs. 10000/- to the satisfaction of the court the same shall be acdepted..
With the above direction the application is finally disposed of.
