Heard counsel for the petitioner and Shri V.K. Singh counsel for the Gaon Sabha and Land Management Committee, respondent nos. 4 and 5. Shri V.K. Singh admits that a copy of the writ petition was served upon him on 20.3.2002. It appears, however that no endorsement of receipt was made on the writ petition. The writ petition was dismissed on 2.8.2002 as against respondent nos. 4 and 5 for not taking steps.
In view of the fact that respondent nos. nos. 4 and 5 are represented through counsel Shri V.K.Singh and copy of the writ petition has also been served upon them, the order dated 2.8.2002 dismissing the writ petition as against respondent nos. 4 and 5 for not taking steps is recalled and the writ petition is restored to its original number.
Shri V.K. Singh counsel for respondent nos. .4 and 5 prays for and is granted three weeks time to file counter affidavit in the writ petition. Petitioner will have three weeks thereafter to file rejoinder affidavit.
