Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicants that the applicant is not named in the F.I.R. He has not been put up for identification. The only allegation against him is that at his pointing out some stoled articles were recovered from an open place on 24.10.2005. The recovery was not support6ed by any public witness. The applicant is in jail since 24.10.2005.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Akhtar involved in Case Crime No. 124 of 2005, under Sections 380 and 411 I.P.C., Police Station Janak Puri , District Saharanpur be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
