The opposite party No.1 is present in the Court today and has also filed an affidavit.
The applicant alleges non-compliance of the interim order dated 28.10.2003 wherein the opposite party was directed to consider the regularisation of the petitioner in accordance with the Rules. It has come on record that the previous officer had considered the case of the applicant and he was found legible to be considered for regularisation. However, the opposite party, who was subsequently posted as a Divisional Forest Officer considered the case of the applicant by order dated 30.1.2006 and rejected the claim of the applicant for regularisation in the service.
In view of the aforesaid, substantial compliance of the interim order has been made, the contempt proceedings are dropped, the notice is discharged and the contempt application is rejected.
If the applicant is aggrieved by the order dated 30.1.2006, it is open to the applicant to move an amendment application in the writ petition challenging the said order.
