It is submitted by learned counsel for the applicant that according to prosecution version 2 kg ganja was recovered from the possession of the applicant which is below the commercial quantity. The applicant is not involved in any other case punishable under the provision of the NDPS Act. There is no public witness to support the recovery.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Deepak Kumar God involved in Case Crime No. 8 of 2006, under Sections 8/20 NDPS Act . Police Station Rasara District Ballia be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
