HIGH COURT OF JUDICATURE OF ALLAHABAD

Hon'ble Janardan Sahai, J.

The patta of the petitioners was cancelled by the order dated 11.11.2002 passed by the Deputy Collector, Chandpur,  Bijnore. Against that order the petitioners preferred a revision, which has been dismissed by the Additional Commissioner. The finding is that the disputed plot is a pond and that the term of five years of the asami patta of the petitioners has expired. The patta was granted to the petitioners after the amendment of Rule 176-A of U.P. Zamindari Abolition and Land Reforms Rules wherein the maximum period for which the asami lease can be granted is five years. The authorities below have given good reasons. No ground for interference has been made out. Dismissed.

12.4.2006.
