Learned Standing Counsel who represents respondents prays for and is granted six weeks time to file counter affidavit. The petitioner will have three weeks thereafter to file rejoinder affidavit.
Until further orders, the operation of the orders dated 27.11.2004 passed by Additional Collector (Finance and Revenue), Saharanpur and the order dated 28.12.2005 passed by the Chief controlling Revenue Authority/Commissioner, Saharanpur Division, Saharanpur remain stayed provided the petitioner deposits within a period of six weeks from today half of the amount payable under the impugned orders before Additional Collector (Finance and Revenue), Saharanpur. Any amount paid by the petitioner in pursuance of the impugned orders shall be adjusted. If any amount exceeding half has been deposited by the petitioner the same shall remain in deposit and shall be subject to the result of the writ petition. In case of default this order shall stand discharged.
