This is Second bail application for bail moved on behalf of the applicant Tula Ram indicted in case crime No.717 of 2003 (S.T. No. 251 of 2003 under section 302 I.P.C. P.S. Kowali Farrukhabad District Farrukhabad .
Heard Shri R.S. Kushwaha, learned counsel for the applicant, learned A.G.A. and have perused the record.
The First Bail Application moved on behalf of the applicant was rejected on merit by an order dated 13.4.2005 passed by this court. This court while rejecting the bail application had directed the trial court to make an endeavour to dispose of the case expeditiously within a period of six months from the date of production of certified copy of the order dated 13.4.2005. The certified copy of the order was produced on 8.5.2005. The evidence of three prosecution witnesses has been recorded. A perusal of the order sheet indicates that prosecution witnesses appeared on some dates but could not be examined due to the presiding officer being on leave and non appearance of the applicant-accused.
No case for grant of bail is made out.
The Second Bail Application moved on behalf of the applicant Tula Ram is hereby rejected. The Additional District and Sessions Judge, room No. 5 Farrukhabad is directed to dispose of session trial No. 251 of 2003 State Vs. Tula Ram under section 302 I.P.C. P.S. Kotwali Farrukhabad District Farrukhabad within a period of four months from the date a certified copy of this order is produced by the applicant.
