Ashok Kumar & Others v. Dy. Director Of Consolidation, Jaunpur & Others - WRIT - B No. 24710 of 2006 RD-AH 8935 (4 May 2006)
Hon. S.N. Srivastava, J.
Heard learned counsel for petitioners and learned counsel for caveator.
By the impugned order, appellate order dated 1.5.2004 was reversed and appeals were directed to be heard and decided in accordance with law.
Considering facts, circumstances and materials on record, I do not find any error of law apparent on the face of record. Petitioners will get full opportunity of hearing before the Appellate authority. However, in the facts of the present case, I direct Appellate authority to decide Appeals in accordance with law after giving opportunity of hearing to the parties within a period of two months from the date of production of a certified copy of this order.
With above observations, writ petition is dismissed.
