It is submitted by Sri R.R. Shiva Hare, learned counsel for the petitioner that there is a recital in the agreement to sell that it is without possession and consequently the stamp duty paid by the petitioner as on such an agreement of sale was proper.
Standing counsel who represents the respondents prays for and is granted three weeks time to file a counter affidavit. The petitioner will have three weeks thereafter to file a rejoinder affidavit.
Until next date of listing no recovery against the petitioner in pursuance of the impugned order dated 30.5.2005 passed by the Additional Collector (Finance and Revenue), Jhansi and the order dated 10.11.2005 passed by the Chief controlling Revenue Authority, U.P., Allahabad shall be made.
