This Special Appeal is directed against the judgment and order of a learned Judge of this Court by which the Writ Petition has been dismissed. The father of the appellant died in harness on 12th October, 2000 and compassionate appointment was granted to the petitioner by appointment letter dated 9th July, 2001 but within a period of three months, the petitioner proceeded on leave for a period of four years. The learned Judge dismissed the Writ Petition as the conduct of the petitioner clearly disentitled him to any relief.
Learned counsel for the appellant has not been able to show from any document that the leave had ever been sanctioned to the petitioner-appellant. He, therefore, remained unauthorisedly absent for a long period of four years. It is clear case of abandonment. The petitioner-appellant was not entitled to any relief and the Writ Petition was rightly dismissed. The Special Appeal is without any force and is, accordingly, dismissed.
