Ahtesham v. D.D.C. And Others - WRIT - B No. 25101 of 2007 RD-AH 10107 (25 May 2007)
Hon'ble Janardan Sahai, J
This petition arises out of chak allotment proceedings. It appears that the petitioner chak holder no. 362 and respondent no.2 chak holder no. 182 are co-tenants. The respondent no.2 was not allotted any land on the road side. His grievance was found favour with the Deputy Director of Consolidation and the Deputy Director of Consolidation has therefore modified the chak - the effect of which is that land on road side has also now been given to respondent no.2. The finding is that by modification made all three chak holders viz., chak holder nos. 182, 186 and 362 would be be getting land on road side according to their share. The adjustment made by the Deputy Director of Consolidation is therefore an equitable one. No ground for interference has been made out. Dismissed.
