Heard learned counsel for the parties.
The respondent No.5 was granted license of fair price shop. His license was cancelled. He filed an appeal. The appeal has been allowed and he has been restored to its original position. The petitioner on the basis of cancellation of the license of the respondent No.5 has been granted license for fair price shop. Against the order passed by the appellate authority in favour of the respondent No.5. he has approached this Court.
The petitioner cannot claim as a matter of right as only on the basis of cancellation of the shop of the respondent No.5, the claim of the petitioner was considered and he was granted license. Once the appeal of the respondent No.5 is allowed, he has right to restored to its original position.
The writ petition is devoid of merits and is hereby dismissed.
No order as to costs.
