Heard Sri Santosh Tripathi, learned counsel for the applicant and learned A.G.A. for the State of U.P. and also perused the record.
It transpires that the applicant-accused was on bail in session Trial No. 1287 of 2006 and 1288 of 2006, but he became absent and hence, warrant was issued against him. Now he is in Jail since 16.04.2006.
It is submitted by learned counsel for the applicant that summons were not served upon applicant and hence, he could not appear in the Court below.
The bail has been opposed by learned A.G.A.
Having heard the parties' counsel and keeping in view all the facts and circumstances of the case, the applicant may be granted one more opportunity to remain on bail.
Let applicant, Parmeet Singh @ Rinku S/o Sri Kuldeep Singh be released on bail in case crime No. 426 of 2004 under Sections 398, 401, 307 I.P.C. and case crime No. 429 of 2004 under Section 4/25 Arms Act, P.S. Indirapuram, District Ghaziabad on his executing a personal bond for Rs.25,000/- and furnishing two sureties each in like amount in crime No. 426 of 2004 and executing a personal bond for Rs.10,000/- and furnishing two sureties each in the like amount in crime No. 429 of 2004 to the satisfaction to the satisfaction of the Court concerned.
