Heard Sri A.P. Tewari and R.S. Tripathi learned counsels for the applicant and learned AGA for the State and perused the papers.

One mobile is said to have been recovered from the applicant.

It is submitted that the applicant has been falsely implicated in this case and he is in jail since 02.05.2007.

Having heard learned counsel for the parties and keeping in view all the facts and circumstances, without expressing any opinion on the merit, the applicant may be granted bail in the case.

Let the applicant Zishan S/o Ali Shan  involved in Case Crime No. 309 of 2007, under section 457, 380, 411 IPC, P.S. Kotwali, District Budaun be released on bail on his executing a personal bond of Rs. 20000/- and furnishing two sureties each in the like amount to the satisfaction of the CJM concerned.
