Hon'ble Arun Tandon, J.

Proceedings under Section 122-B have been initiated on the ground that the petitioner has encroached upon the pond of the Gram Panchayat.  The revision filed against the order of the Tehsildar has also been dismissed by the Additional District Magistrate, Baghpat.

In the opinion of the court there is no illegality in the impugned orders so as to warrant under Article 226 of the Constitution of India.  Petitioner may seek  declaration of his title by way of regular Suit.  He is also at liberty to file an interim stay application as may be necessary in the facts of the present case for protecting his possession, if any.

Writ petition is dismissed.
