Heard learned counsel for the petitioner, learned A.G.A. for the State and perused the record.
It is contended by the learned counsel for the petitioner that in regard to the same subject matter, an earlier FIR was registered as case crime no. 12 of 2006 under Sections 406, 420, 417, 504, 506 IPC wherein the final report was submitted and the informant has filed a protest petition and the same is pending for orders. He further submits that the impugned FIR is the second one in respect of the same office, which is not permissible under law.
Considering the facts and circumstances of the case, in case the investigation into the Case Crime no. 380 of 2007 under Section 420 IPC P.S. Kotwali Banda Distt. Banda has not been concluded till today, the same shall be concluded within a period of three months from the date of presentation of a certified copy of the order and till then the arrest of the petitioner shall remain suspended, provided he co-operates with the investigation.
The petition stands disposed of accordingly.
