Heard counsel for the petitioner.
By this writ petition the petitioner has prayed for mandamus directing the respondents not to appoint any fresh candidate on the post of Shiksha Mitra and if they have already appointed any candidate they must be restrained from working.
The petitioner has earlier filed writ petition No. 60241 of 2006 which was disposed of by this Court on 6.11.2006 directing the District Magistrate to consider the claim of the petitioner. The petitioner's claim was considered by the District Magistrate vide order dated 23.12.2006 and rejected the representation of the petitioner. Petitioner's claim before the District Magistrate is that the petitioner is entitled to be absorbed as Shiksha Mitra since he worked as instructor. The District Magistrate held that there was no such Government order for absorbing the Instructor as Shiksha Mitra and every person claiming entitlement has to undergo the selection process. The petitioner having never applied against Shiksha Mitra the District Magistrate has rightly rejected his claim. The relief claim in the writ petition cannot be granted.
The writ petition is dismissed.
