Heard counsel for the petitioner and the learned standing counsel. No notice is being issued to respondent no. 4 and 5. Liberty is reserved to the respondents No.4 and 5 to move an application for revocation, clarification, variation and modification of the order if they feel so aggrieved.
The petitioner's case in the writ petition is that the petitioner is eligible for promotion as Lecturer (Military Science) which fell vacant on 31.1.2006. Petitioner's case in the writ petition is that he has already represented the matter to the Joint Director of Education by filing representation dated 31.5.2007 Annexure-6 to the writ petition and the same is pending. It is submitted that the recommendation for promotion has been made in respect of respondents No. 4 and 5 by the resolution dated 13.1.2007 but the same has not yet been approved.
In the facts of the case ends of justice be served indisposing of the writ petition directing the Joint Director of Education to consider and take appropriate decision on the representation of the petitioner before taking a decision to grant approval for the post of Lecturer. The Joint Director of Education shall not take any decision adverse to respondents No. 3,4 and 5 unless opportunity is given to them.
With the aforesaid observations the writ petition is disposed of.
