The petitioners filed a suit for possession and injunction. In the suit an application for temporary injunction was also filed. According to the petitioners the defendant is a licencee. The case of the defendant is that the property was gifted to them. The finding is that there is a medical college and hospital being run by defendant-respondents over the disputed land. The appellate court has also relied upon an admission made by the petitioner in a previous suit no. 326 of 1996 that the property in dispute was gifted to the respondents. In the circumstances, the view taken by the court below that no case for grant of temporary injunction is made out does not suffer from any error calling for interference in writ petition. Counsel for the petitioner then prayed that the trial court be directed to dispose of suit suit expeditiously. As the suit is of the year 1999, it is appropriate that the the suit may be disposed of by the trial court expeditiously. Subject to these observations, this petition is dismissed.
