This writ petition has been filed with the following prayers:-
"(a) to issue a writ, order or direction in the nature of MANDAMUS commanding the respondents to permit the petitioner to work as Head Master of Sri Dalchand Madhyamic Vidyalayan Nagla, Mehipal, Jagsaura, Etawah.
(b) respondents be further directed to pay the salary of the post of Head Master to the petitioner.
(c) to award the cost of the writ petition to the petitioner."
I have heard learned counsel for the petitioner and learned Standing Counsel for the State respondents.
Learned counsel for the parties States that the facts involved in this writ petition are squarely covered by the judgment and order of this Court in Writ Petition No. 57868 of 2006; Tilak Singh Vs. State of U.P. and others decided on 18th October,2005.
Considering the facts and circumstances of the case, it is provided that the petitioner may file a fresh representation before respondent No.2 In case any such representation is filed, it may be decided by respondent No.2 by a speaking order, after hearing petitioner and newly added respondent if possible, within two months from the date of receipt of the representation. The petitioner will file certified copy of this order, other necessary documents and a duly stamped self-addressed envelope along with the representation. The respondent No.2 after taking decision will communicate the same to the petitioner.
With these observations, the writ petition is disposed of.
