Heard learned counsel for the petitioner, learned AGA for the State and perused the record.
It is contended by the learned counsel for the petitioner that the petitioner was posted as the then Station Officer and he is alleged to have tortured and harassed to the informant and registered false case against him. His contention is that the allegations made in the impugned FIR are false and concocted as the informant was booked in criminal cases and the cases are still pending, therefore, at this stage it cannot be said that the cases were falsely registered against him. The petitioner is still posted as the Station Officer and pursuant to the impugned FIR, he apprehends his arrest. He is ready to co-operate with the investigation, so no coercive measure be initiated against him.
On the other hand, Sri R.S.Maurya, learned AGA submits that he may be granted ten days' time to file counter affidavit. Time to file counter affidavit is granted.

The investigation into case crime no. 961 of 2007 under Sections 342, 323, 504, 506 IPC and 3(1)(x) SC/ST Act P.S. C.B.Ganj Distt. Bareilly shall go on but no coercive measure shall be initiated against the petitioner till the date fixed, provided he co-operates with the investigation and shall make himself available to the investigating agency, whenever required.
