Learned Standing Counsel prays for and is granted two weeks' time to file counter affidavit. Rejoinder affidavit may be filed within one week thereafter.
List immediately thereafter for admission.
Learned counsel for the petitioner submitted that the petitioner has operated the shop on daily basis till 23rd July, 2002 and has not been issued permanent license inasmuch as the security amount has also not been deposited. In these circumstances, the petitioner is not liable for the payment of license fee for the entire year. In support of his contention, he relied upon the decision of this Court in the case of Anil Kumar and others Versus State of U.P. reported in 2006 (10) ADJ 366.
In view of the aforesaid circumstances, meanwhile recovery of the disputed demand shall remain stayed provided the petitioner deposits the entire dues for the period during which he has run the shop.
