Heard learned counsel for the petitioner, learned Standing Counsel appearing for respondents no. 1 to 3 and Sri Anuj Kumar appearing for respondent no. 4.

In view of the order proposed to be passed hereunder, I do not consider it necessary to put private respondents no. 5 to 8 to notice.

An application filed by petitioner under section 28 of the U. P. Land Revenue Act impleading the respondents no. 4 to 8 was decided by the trial court vide order dated 31st March, 2006. The said order was challenged in revision by respondents no. 7 and 8 before the learned Additional Commissioner who vide order dated 8.6.2006 stayed the effect and operation of the order passed by the trial court. Petitioner went up in revision before the Board of Revenue against the order dated 8.6.2006 who allowed the revision and directed the Commissioner to decide the revision expeditiously. Subsequently, respondents no. 5 and 6 filed another revision before the Board of Revenue, U. P. at Meerut against the order dated 31st March, 2006 passed by the trial court. Petitioner moved an application dated 11.9.2006 in the said revision brining the fact to the knowledge of the Board of Revenue that against the same order two revisions are pending. Grievance of the petitioner is that though more than one year has passed but the said application is still pending disposal.

Considering the facts and circumstances, this writ petition is finally disposed of with the direction to the respondent no. 2, Board of Revenue, U. P. Camp at Meerut to dispose of the application dated 11.9.2006 filed by the petitioner in accordance with law after notice and opportunity of hearing all concerned within a period of two months from the date of production of a certified copy of this order before it.
