Heard Sri Madan Lal Srivastava, learned counsel for the petitioner and learned Standing Counsel for the respondents.
The petitioner was granted a mining lease for a period of ten years from 9.1.1997 to 8.1.2007 but he was not permitted to run the mines for a period of 1 year 3 months. He has moved a representation-dated 22.12.2006 before respondent no.2, District Magistrate, Sonebhadra, which is annexed as Annexure-10 to the writ petition. In support of his submission learned counsel for the petitioner has relied upon a decision of the Apex Court in the case of Beg Raj Singh Vs. State of U.P. & others reported in A.I.R. 2003 SC 833.
In the facts and circumstances of the case, we direct the respondent no.2, District Magistrate, Sonebhadra to decide the aforesaid representation of the petitioner within a period of 3 weeks from the date of filing of a certified copy of this order, taking into consideration the aforesaid decision of the Apex Court.
With the aforesaid observation, the writ petition is disposed of.
