Counsel for the petitioner submitted that an exparte order under Section 33/39 of the U.P. Land Revenue Act was passed against the petitioner and the petitioner has filed a recall application for setting aside that order which is pending since 1999. It is prayed that the Sub Divisional Magistrate, Kashganj, District Etah be directed to dispose of the application within a time bound period.

I have heard the standing counsel and Sri V.K. Singh counsel for the Land Management Committee also.

In the facts and circumstances this petition is disposed of with the direction to respondent no.2 the Sub Divisional Magistrate, Kashganj, District Etah to dispose of the recall application of the petitioner, if it is still pending, expeditiously and if possible within a period of six months from the date certified copy of this order is filed before him.
