Ram Awatar v. State Of U.P. & Others - WRIT - C No. - 42435 of 2007 RD-AH 15100 (6 September 2007)
HIGH COURT OF JUDICATURE AT ALLAHABAD
Hon. Janardan Sahai,J
The petitioner filed a suit under Section 229B of the U.P.Zamindari Abolition & Land Reforms Act in which an application for temporary injunction under Section 229D of the Act was filed by the petitioner. The same was rejected by the trial court on 11.10.02 and the revision against that order has also been dismissed. The petitioner's case is that the disputed land was originally allotted to him but the allotment was cancelled in the year 1997 and the land in question was allotted to the respondent 5 and 6 and the petitioner filed an application for cancellation of that allotment. It appears that the application was dismissed but a revision against the order is still pending. The order under challenge is an interlocutory one. The petitioner has not been able to establish any prima facie case. The finding is that the name of the alottee has been recorded. No ground for interference has been made out. Dismissed. However the trial court shall try to decide the suit expeditiously.
