Heard counsel for the petitioner.
By this writ petition the petitioner has prayed for quashing the sale proclamation Annexure-5 to the writ petition by which 25.8.2007 was the date fixed for sale proclamation. Learned counsel for the petitioner submits that in the sale proclamation plot No. 385 has been included whereas the petitioner has requested for selling his another plot which was also mortgaged with the Bank i.e. Plot No. 131 Khata No. 188. Both the plots are situated in different villages and it is for the respondents to take action for recovery. Learned counsel for the petitioner submits that the Collector has passed an order on the application of the petitioner directing the Sub Divisional Officer to consider the grievance of the petitioner. Be as it may, it is for the authorities who are in-charge of the recovery to take decision regarding then steps to be taken. No direction by this Court can be issued in this regard. Petitioner may bring into notice of the Sub Divisional Officer, the order of the Collector.
With the above observations the writ petition is disposed of.
