A suit for declaration was filed by the plaintiff/petitioner in respect of a motorcycle on the basis of a will of his deceased brother Sukh Dev Singh. In the suit an application for impleadment was filed by the respondent Indrajeet Kaur alleging that she is the widow of the deceased and that the suit has been filed in collusion with the defendants without impleading her. The trial court has allowed the application for impleadment. Revision filed against the order has been dismissed. It was submitted by the petitioner's counsel that Indrajeet Kaur is an impostor. The question is one of fact and can be decided on the basis of evidence. The courts below have not committed any error in directing impleadment of Indrajeet Kaur for effective adjudication of the question of ownership of the motorcycle. Dismissed.
