Notice could not be served on respondent No.2 since 1975.    Fresh steps were directed to be taken on 30.10.1985 and then on 02.12.1988.    The respondent No.2 is necessary party to the second appeal.   The second appeal, consequently, abates against respondent No.2.  The appeal, however, cannot be argued against respondent No.1 as plaintiff appellant has sought declaration in the suit about the validity of Shiksha Shastri degree conferred by respondent No.2-college as equivalent to B.Ed.  The suit was dismissed.

When the matter was called out, no one appears for the appellant.  The second appeal is, consequently, dismissed for want of prosecution.
