It is submitted by Sri Amit Singh, learned counsel for the petitioner that the objections under Section 9-A of the U.P. Consolidation of Holdings Act were allowed in favour of the petitioner by an order of the Consolidation Officer dated 15.3.2002 and as the said order was not being given effect to the petitioner has made an application before the Consolidation Officer for that purpose. The prayer pressed is that the Consolidation Officer be directed to dispose of the application filed by the petitioner.
I have heard the learned standing counsel and the counsel for the Gaon Sabha also.
In the facts and circumstances the writ petition is disposed of with a direction to the Consolidation Officer to pass appropriate order on the application of the petitioner dated 30.6.2007. It is made clear that no opinion upon the merits of the petitioner's case is being expressed by this Court and it is for the Consolidation Officer to examine and to decide the casein accordance with law.
With these directions the writ petition is disposed of finally.
