Heard counsel for the petitioner and the learned standing counsel. No notice is being issued to respondent no. 1. Liberty is reserved to the respondents No. 1 to move an application for revocation, clarification, variation and modification of the order if he feels so aggrieved.
By this writ petition the petitioner has prayed for a writ of mandamus directing the respondent No. 2 to decide the election petition No. 1 of 2005 filed under Sections 12-C of the U.P. Panchayat Raj Act, 1947. The election petition was filed by the petitioner on 14.9.2005 copy of order sheet has been brought on record as Annexure-3 to the writ petition which indicate that both the parties have appeared. Learned counsel for the petitioner submits that the revision filed by the respondent no. 1 has already been dismissed against the order deciding the maintainability of the election petition.
In the facts of the present case specially the fact that the writ petition is pending for the last two years, it is appropriate that the election petition be disposed of expeditiously preferably within a period of six months from the date of production of a certified copy of this order.
With the above observations the writ petition is disposed of.
