Heard counsel for the petitioner and Sri Rajesh Tiwari appearing for the respondents. Learned counsel for parties agrees that the writ petition be disposed of finally.
By this writ petition the petitioner has prayed for quashing the order dated 2.2.2007. The respondents have claimed the amount of contribution for the period from 1.5.1995 to 20.4.1997. Learned counsel for the petitioner submits that the petitioner has made payment from April, 1995 to March 1996 . learned counsel for the petitioner submits that the petitioner has submitted detailed letter dated 24.7.2006 giving details of the payment which has not been considered while passing the impugned order. In the order which has been passed there does not appear to be any consideration of aforesaid payments.
Ends of justice be served in directing the respondent no. 3 to pass a fresh order after considering the letter of the petitioner dated 24.7.2006. The said decision shall be taken expeditiously preferably within a period of three months from the date of production of a certified copy of this order. The future steps l; shall be taken on the basis of the order passed by the respondent no. 3. Till the application is decided the recovery in pursuance of the impugned order shall be kept in abeyance.
With the above observation the writ petition is disposed of.
