The petitioner is challenging the order dated 5/10/07 of the District Panchayat Raj Officer, Azamgarh by which he has fixed 1.11.07 for consideration of no confidence motion against the petitioner who is the Pradhan. Counsel for the petitioner submitted that the mandatory 15 days notice as required under Section 14 of the U.P.Panchayat Raj Act was not given. The contention does not have any merit. It is said that on the basis of the resolution in the meeting on 23.9.07 a notice of intention dated 3.10.07 to move a motion for no confidence was brought and on 5.10.07 by order of the District Panchayat Raj Officer the meeting has been convened for 1.11.07. There is nothing to show that 15 days notice as required under Section 14 of the Act was not given. In the order it has been found that more than half the members of the gaon sabha have put their signatures on the notice. No ground for interference under Article226 of the Constitution of India has been made out. Dismissed.
