Heard learned counsel for the petitioners, learned A.G.A. appearing for the State and Sri A.K. Singh who files power on behalf of complainant.
Supplementary affidavit has been filed on behalf of the petitioners.
We have been taken through the allegations contained in the F.I.R. and also the materials on record.
Sri A.K. Singh prays for and is granted ten days time to file counter affidavit. Learned A.G.A. may also file counter affidavit within the said period. Rejoinder affidavit may thereafter be filed within three days.
List this matter after the expiry of the aforesaid period.
Till next date of listing or till submission of charge sheet whichever is earlier, the arrest of the petitioners namely, Bhaiya Lal, Rameshwar, Jai Chandra, Byas Narain, Krishna Murari alias Tenu, Chibilla alias Yatindra, Washistha alias Langar, Laulesh, Ram Newaj, Uydhav Shyam, Kodai, Pillu and Jai Babu who are wanted in case crime no. 318 of 2007 under sections 147, 504, 506 I.P.C. and 3(1) X of S.C.and S.T. Act P.S. Manjhanpur District Kaushambi shall remain stayed of course subject to the restraint that the petitioners shall fully cooperate with the investigation and shall appear as and when called upon to assist in the investigation. In case the petitioners default in any manner, the above order shall cease to be operative.
