Heard learned counsel for the applicants and the learned A.G.A.
It is submitted by learned counsel for the applicants that the applicants are not the resident of the house in which the dead body of the deceased was found. The main allegation against Gaya Prasad son of the deceased. The applicant no.1 is the brother in law(Sala) of Gaya Prasad. Applicant no. 2 is nephew of applicant no.1. Gaya Prasad is the main accused against whom it is alleged that he has committed the murder of his father. The co-accused Mahesh and Smt. Ruchi have been released on bail by this court on 30.11.2006 in criminal misc. bail application no. 26242 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case the applicants are entitled to be released on bail.
Let the applicants Nanhey Lal and Ram Niwas involved in case crime no. 522 of 2007 under Sections 302,34 I.P.C., P.S. Bilsanda District Pilibhit be released on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
