Purvanchal Shashkiya Adhivakta Kalyan Samiti And Another v. State Of U.P. And Others - WRIT - C No. 8958 of 2007 RD-AH 2760 (20 February 2007)
Hon. Anjani Kumar, J.
Hon. Dilip Gupta, J.
This petition has been filed for quashing the Government Order dated 11.12.2002 which provides that the engagement of the District Government Counsel would be up to the maximum age of 62 years only and for a direction upon the respondents to permit the petitioners as District Government Counsel up to the age of 65 years. The contention of the petitioners is that the age has been illegally reduced from 65 years to 62 years.
Having heard the learned counsel for the parties, we are of the opinion that it is for the Government to prescribe the age up to which the District Government Counsel can be engaged and it is not for the Courts to either increase or decrease the age. In this view of the matter, it is not possible to grant the reliefs claimed for in this petition.
The writ petition is, accordingly, dismissed.
