Rajendra Narain Dubey v. State Of U.P. And Others - WRIT - C No. 8995 of 2007 RD-AH 2764 (20 February 2007)
Hon. Anjani Kumar, J.
Hon. Dilip Gupta, J.
This petition has been filed for a direction upon the State-respondents to take steps relating "to the possibility of illegal and unauthorised possession and occupation of land relating to pond etc." The averments made in the writ petition indicate that on 15.5.2001 the Sub-Divisional Magistrate had passed an order which was not complied with in its entirety by the Police officers. The petitioner has mentioned in paragraph 7 of the writ petition that a direction was issued to all the District Magistrates to take effective steps. There is nothing on the record which indicates that the petitioner had ever approached the District Magistrate. In such a situation, this petition cannot be entertained.
The writ petition is, accordingly, dismissed. It will, however, be open to the petitioner to pursue his remedy before the appropriate authority.
