Heard Sri R.P.Dubey, learned counsel for the petitioner, learned Standing counsel for the State-respondents as well as Sri A.K.Singh for the contesting respondents. Pleadings have been exchanged and with consent of the learned counsel for the parties, this writ petition is being disposed of at this stage.

The petitioner is an Assistant Teacher who was officiating as Head Mistress of the respondent-college. By an order dated 7.11.2003 she was placed under suspension. Challenging the said order, the petitioner filed writ petition no. 40029 of 2004 which was disposed of by this Court vide order dated 27.9.2004 with a direction that the enquiry as contemplated by the suspension order be completed expeditiously, preferably within three weeks. As a consequence thereof, the enquiry report was submitted and disciplinary proceedings were initiated against the petitioner recommending her dismissal from service. Sri A.K.Singh, learned counsel for the contesting respondents no. 3 to 5 has submitted that the papers relating to the disciplinary action have already been forwarded to the District Basic Education Officer, Allahabad on 4.7.2006 for its approval.

In the aforesaid circumstances, with consent of the learned counsel for the parties this writ petition is disposed of with the direction that the District Basic Education Officer, Allahabad. Respondent no.7, shall pass speaking and reasoned order, in accordance with law, after giving an opportunity of hearing to the petitioner as well as the contesting respondents and other concerned parties if there be any, as expeditiously as possible, preferably within a period of two months from the date of filing of a certified copy of this order before him.

With the aforesaid observation/direction this writ petition stands disposed of. No order as to cost.
