List in the next cause list to enable the petitioner to file a copy of the inquest report because it is the positive case of the petitioner that the girl died due to snake bite but the postmortem report does not show any snake bite marks. If the inquest report also does not show any marks of snake bite, the suspicion expressed in the First Information Report that the girl has been done to death by other means will stand prima facie corroborated.
After the above order was dictated, learned counsel for the petitioner expressed the desire to confine the relief to getting the bail application of the petitioner decided expeditiously.
In the circumstances, we decline to either quash the F.I.R., or stay the arrest.
However, if the petitioner surrenders and applies for bail in case crime No. 54 of 2006 under sections 498A/304-B I.P.C., and section ¾ of the D.P. Act, P.S. Basai Mohammadpur district Firozabad, her bail application will be considered and disposed of by both the Courts below expeditiously.
The writ petition is disposed of as above.
