Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that applicant is not named in F.I.R., but after two years of the alleged incident one stolen motar cycle has been recovered from the possession of the applicant, but the recovery is not supported by any independent witness. In reply to the above contention it is submitted by learned A.G.A. that the applicant is resident of Nepal. In case he is released on bail, his presence can not be ensured.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Shankar Sharma involved in case crime no. 710 of 2004 under Sections 379, 411 I.P.C, P.S. Shahpur, District Gorakpur be released on bail on his furnishing a personal bond and two local sureties each in the like amount to the satisfaction of the Court concerned.
