This application has been filed by Mohammad Umar with a prayer that the proceedings of complaint case no. 7 of 2005 under sections 135/138 Electricity Act pending in the court of learned Special Judge, (E.C.Act ) may be quashed.
It is contended by the learned counsel for the applicant that the allegation in respect of the use of electricity is in respect of the house belonging to Rais Ahmad. There is no allegations in respect of the use of electricity against the applicant. The allegations made against the applicant are false and frivolous.
From the perusal of the rerecord, it appears that there is no illegality or irregularity in taking the cognizance against the applicant. Therefore, the prayer for quashing the criminal proceedings is refused.
However, it is directed that if the applicant moves an application raising the objections within 15 days from today, the same shall be considered and disposed of within one months from the date of filing such application.
With this direction this application is finally disposed of.
